General Terms and Conditions of the GOLF CLUB CARD Mallorca

This is a translation of the legally binding terms and conditions below.

1. Scope

These General Terms and Conditions (GTC) apply to all orders of the GOLF CLUB CARD Mallorca through the online shop of Arena Sportwerbung AG (hereinafter "the Provider") with its registered office in Switzerland. They apply to customers in Switzerland as well as in the European Union (EU). Swiss law is applicable, taking into account the mandatory consumer protection regulations of the customer's country of residence. By submitting the order, customers accept these GTC in the version valid at the time of the order. Deviating general terms and conditions of customers do not apply unless the provider explicitly agrees to their validity in writing.

3. Subject of the Contract

The GOLF CLUB CARD Mallorca is a personalized benefit card, which entitles the holder to purchase discounted services at participating golf courses in Mallorca as well as additional cooperation partners during its validity period. Price discounts at the golf courses apply exclusively to the regular green fee rates set by the respective golf courses and are not combinable with other discounts, special offers, or vouchers. The card is not a cashless payment method; free services are not included. The provider is the sole contractual partner for the purchase of the card. The current list of participating golf courses and partner deals is available on the website mallorca.golf-clubcard.com. Access to partner deals of cooperation partners is available through the customer account on the website (login).

The provider explicitly reserves the right to change the partner offers, especially in cases of closures, capacity limits, or changed cooperation agreements. Changes to the partner offer do not entitle the customer to a refund, reduction, or cancellation. The contractual partner for the provision of services, such as discounted green fees or other partner deals, is exclusively the respective golf course or cooperation partner.

4. Offer and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer from the provider but is an invitation to the customer to make an offer. By submitting the order, the customer makes a binding offer to conclude a purchase and use agreement. The contract is concluded with the provider, specifically through the sending of an order confirmation via email or the delivery of the personalized card.

5. Order and Payment

Only one GOLF CLUB CARD Mallorca per person is permitted and is only available to individuals aged 18 or older. By submitting the order, the customer confirms that they meet the required minimum age. The purchase price is visible during the ordering process and is due immediately. Payment is made through the payment methods offered in the online shop. All prices are quoted in Swiss Francs (CHF) or Euros (EUR), depending on the currency selected during the order process.

For deliveries to Switzerland or Liechtenstein, the prices for the card and shipping include the statutory VAT. For deliveries abroad, the prices are generally quoted excluding VAT. Shipping costs are separately listed during the order process and are to be borne by the customer. For deliveries abroad, there are generally no VAT, customs duties, or import charges. Should any fees arise, the customer is responsible for them.

6. Right of Withdrawal and Commencement of Contract Performance

The GOLF CLUB CARD Mallorca is a pre-made, personalized product. There is no right of withdrawal, as the card is created and personalized according to the customer's request. Returns or refunds after submitting the order are excluded. This applies to customers in Switzerland, Liechtenstein, all EU and EEA countries, and third countries. By placing the order, the customer expressly agrees that the provider will begin the creation of the personalized card immediately after the conclusion of the contract. The customer confirms that they are aware that the right of withdrawal expires with the commencement of contract performance, unless such a right is provided under the law of the customer's country of residence.

7. Personalization and Shipping

The GOLF CLUB CARD is personalized and shipped to the address provided by the customer. The customer is obligated to provide complete and accurate address information and to verify it before completing the order, as the provider is not liable for errors or delays resulting from incorrect information. Shipping is from Switzerland. Once the card has been handed over to the shipping service provider, the customer assumes the risk of loss or damage. Should the card not arrive within the usual delivery time or be damaged, the provider must be informed immediately. The provider will then investigate the incident and may offer a replacement if the investigation determines that the shipping service provider has lost or damaged the card.

8. Use of the Card and Partner Benefits

The GOLF CLUB CARD Mallorca is non-transferable and entitles the holder exclusively to use the partner offers published on the website mallorca.golf-clubcard.com. Benefits with partners are personal and available exclusively to registered holders of a valid GOLF CLUB CARD Mallorca. A right to discounts and partner deals exists only upon presentation of the valid physical card and within the scope of the currently offered partner benefits. Passing on the GOLF CLUB CARD to other persons, or sharing promotion codes or partner links with third parties, is not permitted.

All partners may require the presentation of a valid GOLF CLUB CARD Mallorca when a benefit is claimed and may verify the cardholder’s identity, including name, card number, and expiration date. If the customer cannot provide this, the partner is entitled to revoke the granted benefit and charge the regular conditions (e.g. standard hotel rate or standard rack rate). This also applies if the benefit has already been redeemed in advance via a promotion code or booking link. A digital version of the card is generally not accepted, unless the partner explicitly allows this.

Access to the partner offers of cooperation partners (partner deals) is available to cardholders who are logged into their customer account and possess a valid GOLF CLUB CARD Mallorca. Visitors who are not logged in can view the offers but cannot access the partner websites. Please note that by clicking on a partner link you leave our website and are redirected to the partner’s website. The provider is not responsible for the content, booking processes, or technical functions of external websites. Likewise, the processing of a booking and compliance with the conditions is the sole responsibility of the respective partner. The partner’s general terms and conditions (GTC) apply.

The provider is not liable for changes, unavailability, or the removal of individual partners or deals. There is no entitlement to specific benefits or partner offers. Changes to the partner deals do not entitle the customer to a refund, reduction, or cancellation. This also applies if the decision to purchase the GOLF CLUB CARD Mallorca was originally based on an offer that is no longer available. For services such as discounted green fees or other partner deals, the contractual partner is exclusively the respective golf course or cooperation partner. When booking services with cooperation partners, the contract is made only between the cardholder and the partner. The provider is not involved in these agreements. Payment for discounted green fees or other benefits is not possible via the provider’s online shop, but must be made directly with the respective golf course or cooperation partner. Only their payment and cancellation terms apply.

9. Term

The GOLF CLUB CARD Mallorca is valid for one year (365 days) from the date of issuance and is immediately usable upon receipt. The card must be signed on the back before the first use. The expiration date is printed on the card. Once the expiration date has passed, the card becomes invalid. There is no right to a refund for unused benefits, such as already booked discounted green fees. Benefits cannot be transferred to the following season. The card does not automatically renew, and no cancellation is required.

10. Loss and Replacement Card

In case of loss, the card must be reported immediately. A replacement card will be issued for a processing fee of CHF/EUR 30 and will have the same validity as the original card. The original card will be deactivated, and the replacement card will have the same card number and validity as the original.

11. Liability

The provider is fully liable for intent and gross negligence. For minor negligence, the provider is only liable for breaches of essential contractual obligations that could significantly disadvantage the customer. The liability is limited to the typically foreseeable damage. No liability is accepted for services or changes by partner companies (golf courses, hotels, cooperation partners), technical failures or errors in the online shop, login problems, display issues with partner offers, shipping, loss or damage to the card, unauthorized use of the card or customer account, external link content, newsletters, or marketing materials, damages or accidents while using partner offers, taxes, customs duties, import charges, or bank fees for international transactions, delays due to factors beyond the provider’s control (e.g. strikes, government orders, force majeure), organization or execution of tee times, or cancellation fees ("no-show" costs) arising from non-appearance or late cancellation by the cardholder at the golf course.

12. Data Protection

The privacy policy published on the website applies. Personal data is processed exclusively for order processing and card management.

13. Trademarks and Copyright

The term "GOLF CLUB CARD Mallorca," the website, product names, and the design are protected by copyright. Any use or reproduction without the provider's consent is prohibited. The provider within the meaning of these GTC is Arena Sportwerbung AG. Even if the term "GOLF CLUB CARD Mallorca" is communicated in external presentations, Arena Sportwerbung AG remains the sole contractual partner.

14. Applicable Law and Jurisdiction

Swiss law applies, excluding the UN Sales Convention. For consumers outside Switzerland, the mandatory provisions of the country of residence also apply. The competent court is the provider's registered office unless mandatory statutory provisions of the consumer's country of residence provide otherwise.

15. Contract Language

The contract language is German. Any translations are provided for informational purposes only and have no legal effect.

16. Dispute Resolution

The provider does not participate in dispute resolution procedures before a consumer arbitration board.

17. Miscellaneous

Information on the website or in the customer account regarding booking processes, prices, required handicaps, dress codes, or other partner terms and conditions is for orientation purposes only. Only the GTC of the partner companies and these GTC are binding. The provider assumes no liability for the accuracy, completeness, or timeliness of this information.

18. Final Provisions

Should any provision of these GTC be invalid, the validity of the remaining provisions shall remain unaffected. Any changes to these GTC will be communicated in text form. The version valid at the time of the order shall apply.

1. Geltungsbereich

Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Bestellungen der GOLF CLUB CARD Mallorca über den Online-Shop der Arena Sportwerbung AG (nachfolgend „Anbieter“) mit Sitz in der Schweiz. Sie richten sich sowohl an Kunden in der Schweiz als auch in der Europäischen Union (EU). Massgeblich ist schweizerisches Recht unter Berücksichtigung zwingender Verbraucherschutzbestimmungen des jeweiligen Wohnsitzstaates des Kunden. Mit Abgabe der Bestellung akzeptieren Kundinnen und Kunden diese AGB in der zum Zeitpunkt der Bestellung gültigen Fassung. Abweichende Allgemeine Geschäftsbedingungen von Kundinnen und Kunden finden keine Anwendung, es sei denn, der Anbieter stimmt ihrer Geltung ausdrücklich schriftlich zu.

3. Vertragsgegenstand

Die GOLF CLUB CARD Mallorca ist eine personalisierte Vorteilskarte, die während ihrer Gültigkeitsdauer zum Erwerb vergünstigter Leistungen bei teilnehmenden Golfplätzen auf Mallorca sowie weiteren Kooperationspartnern berechtigt. Die Preisvorteile bei den Golfplätzen beziehen sich ausschliesslich auf die von den jeweiligen Golfplätzen festgelegten, tagesaktuellen regulären Greenfee-Tarife und sind nicht mit anderen Rabatten, Sonderaktionen oder Gutscheinen kombinierbar. Die Karte ist kein bargeldloses Zahlungsmittel; kostenfreie Leistungen sind nicht umfasst. Der Anbieter ist ausschliesslicher Vertragspartner für den Erwerb der Karte. Die jeweils aktuelle Liste der teilnehmenden Golfplätze und Partner Deals ist auf der Website mallorca.golf-clubcard.com abrufbar. Der Zugriff auf die Partner Deals der Kooperationspartner erfolgt über das Kundenkonto auf der Website (Login).

Der Anbieter behält sich ausdrücklich Änderungen im Partnerangebot vor, insbesondere bei Schliessung, Kapazitätsgrenzen oder geänderten Kooperationsvereinbarungen. Änderungen des Partnerangebots begründen keinen Anspruch auf Rückerstattung, Minderung oder Kündigung. Vertragspartner für die Erbringung der Leistungen, d.h. vergünstigte Greenfees oder andere Partner Deals sind ausschliesslich die jeweiligen Golfplätze bzw. Kooperationspartner (Partner Deals).

4. Angebot und Vertragsabschluss

Die Darstellung der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot des Anbieters dar, sondern eine unverbindliche Aufforderung an den Kunden, ein Angebot abzugeben. Mit Absenden der Bestellung gibt der Kunde ein verbindliches Angebot zum Abschluss eines Kauf- und Nutzungsvertrages ab. Der Vertrag kommt durch den Anbieter zustande, insbesondere durch Versandbestätigung per E-Mail oder durch Auslieferung der personalisierten Karte.

5. Bestellung und Zahlung

Es ist nur eine GOLF CLUB CARD Mallorca pro Person erlaubt und nur für Personen ab 18 Jahren erhältlich. Mit dem Absenden der Bestellung bestätigt der Kunde, das erforderliche Mindestalter erreicht zu haben. Der Kaufpreis ist im Bestellprozess ersichtlich und sofort fällig. Die Zahlung erfolgt über die im Online-Shop angebotenen Zahlungsmethoden. Alle Preisangaben erfolgen in Schweizer Franken (CHF) oder Euro (EUR), abhängig von der im Bestellprozess ausgewählten Währung.

Für Lieferungen in die Schweiz oder nach Liechtenstein verstehen sich die Preisangaben für Karte und Versand inklusive gesetzlicher Mehrwertsteuer. Für Lieferungen ins Ausland verstehen sich die Preise in der Regel ohne Mehrwertsteuer. Die Versandkosten werden im Bestellprozess separat ausgewiesen und sind vom Kunden zu tragen. Für Lieferungen ins Ausland fallen in der Regel keine Mehrwertsteuer, Zollgebühren oder Einfuhrabgaben an. Fallen etwaige Gebühren an, trägt sie der Kunde.

6. Widerrufsrecht und Beginn der Vertragserfüllung

Die GOLF CLUB CARD Mallorca ist ein vorgefertigtes, personalisiertes Produkt. Ein Widerrufsrecht besteht nicht, da die Karte auf Kundenwunsch erstellt bzw. personalisiert wird. Rückgabe oder Erstattung nach Absenden der Bestellung ist ausgeschlossen. Dies gilt für Kunden in der Schweiz, Liechtenstein, allen EU- und EWR-Staaten sowie Drittstaaten. Mit der Bestellung stimmt der Kunde ausdrücklich zu, dass der Anbieter unmittelbar nach Vertragsschluss mit der Erstellung der personalisierten Karte beginnt. Der Kunde bestätigt, dass ihm bekannt ist, dass mit Beginn der Vertragserfüllung das Widerrufsrecht erlischt, sofern ein solches nach seinem Wohnsitzstaat überhaupt vorgesehen ist.

7. Personalisierung und Versand

Die GOLF CLUB CARD wird personalisiert an die vom Kunden angegebene Adresse versendet. Der Kunde ist verpflichtet, vollständige und korrekte Adressangaben zu machen und diese vor Abschluss der Bestellung noch einmal zu überprüfen, da der Anbieter nicht für Fehler oder daraus entstehende Verzögerungen haftet. Der Versand erfolgt aus der Schweiz. Sobald die Karte an den Versanddienstleister übergeben wurde, trägt der Kunde das Risiko für Verlust oder Beschädigung. Sollte die Karte nicht innerhalb der üblichen Lieferzeit ankommen oder beschädigt sein, ist der Anbieter umgehend zu informieren. Der Anbieter wird den Vorfall dann prüfen und gegebenenfalls einen Ersatz anbieten, falls die Nachforschung ergibt, dass der Versanddienstleister die Karte verloren oder beschädigt hat.

8. Nutzung der Karte und Partnerleistungen

Die GOLF CLUB CARD Mallorca ist nicht übertragbar und berechtigt ausschliesslich zur Inanspruchnahme der auf der Website mallorca.golf-clubcard.com veröffentlichten Partnerangebote. Vorteile bei Partnern sind personengebunden und stehen ausschliesslich registrierten Inhaberinnen und Inhabern einer gültigen GOLF CLUB CARD Mallorca zur Verfügung. Ein Anspruch auf Preisnachlässe und Partner-Deals besteht nur durch die Vorlage der gültigen physischen Karte und im Rahmen der aktuell angebotenen Partnerangebote. Die Weitergabe der GOLF CLUB CARD an andere Personen oder eine Weitergabe von Aktionscodes oder Partner-Links an Dritte ist nicht gestattet.

Alle Partner sind berechtigt, bei Inanspruchnahme eines Vorteils die Vorlage der gültigen GOLF CLUB CARD Mallorca zu verlangen und die Gültigkeit sowie die Identität des Karteninhabers (Name, Kartennummer, Gültigkeitsdatum) zu prüfen. Die Bezahlung vergünstigter Greenfees oder anderer Vorteile ist nicht über das Kundenkonto im Onlineshop des Anbieters möglich, sondern erfolgt direkt beim jeweiligen Golfplatz oder Kooperationspartner. Für Buchung und Bezahlung gelten ausschliesslich deren Zahlungs- und Stornierungsbedingungen.

9. Laufzeit

Die GOLF CLUB CARD Mallorca ist ab Ausstellungsdatum ein Jahr (365 Tage) gültig und nach Erhalt sofort einsetzbar. Vor der ersten Nutzung ist sie auf der Rückseite zu unterzeichnen. Das Ablaufdatum steht auf der Karte. Mit Überschreiten des Ablaufdatums verliert die Karte ihre Gültigkeit. Es besteht kein Anspruch auf Erstattung nicht eingelöster Vorteile, wie etwa bereits gebuchte vergünstigter Greenfees. Vorteile können nicht in die Folgesaison übertragen werden. Die Karte verlängert sich nicht automatisch; eine Kündigung ist nicht erforderlich.

10. Verlust und Ersatzkarte

Ein Kartenverlust sollte umgehend gemeldet werden. Eine Ersatzkarte wird gegen eine Bearbeitungsgebühr von CHF/EUR 30 ausgestellt und hat dieselbe Gültigkeit wie die Originalkarte. Die ursprüngliche Karte wird deaktiviert, und die Ersatzkarte erhält die gleiche Kartennummer sowie Gültigkeit wie die Originalkarte.

11. Haftung

Der Anbieter haftet unbeschränkt für Vorsatz und grobe Fahrlässigkeit. Für leichte Fahrlässigkeit haftet der Anbieter nur bei Verletzung wesentlicher Vertragspflichten, die den Kunden erheblich benachteiligen könnten. Die Haftung ist in diesen Fällen auf den typischerweise vorhersehbaren Schaden begrenzt. Eine Haftung für leichte Fahrlässigkeit ist ausgeschlossen, wenn diese keine wesentlichen vertraglichen Rechte des Kunden beeinträchtigt oder zu einem wesentlichen Schaden führt.

Keine Haftung besteht für Leistungen oder Änderungen von Partnerunternehmen (Golfplätze, Hotels, Kooperationspartner), technische Ausfälle oder Fehler im Online-Shop, Login-Probleme oder Anzeige von Partnerangeboten, Versand, Verlust oder Beschädigung der Karte, unbefugte Nutzung von Karte oder Kundenkonto, Inhalte externer Links, Newsletter oder Marketingmaterialien, Schäden oder Unfälle bei Nutzung der Partnerangebote, Steuern, Zoll, Einfuhrabgaben oder Bankgebühren bei Auslandstransaktionen, Lieferverzögerungen, die auf Umstände zurückzuführen sind, welche ausserhalb des Einflussbereichs des Anbieters liegen (z.B. Streiks, behördliche Anordnungen, höhere Gewalt), Organisation oder Durchführung von Abschlagzeiten sowie allfällige Stornogebühren („No-Show“-Kosten), die durch Nichterscheinen oder verspätete Stornierung durch den Karteninhaber beim Golfclub entstehen.

12. Datenschutz

Es gilt die auf der Website veröffentlichte Datenschutzerklärung. Personenbezogene Daten werden ausschliesslich im Rahmen der Bestellabwicklung und Kartenverwaltung verarbeitet.

13. Marken- und Urheberrechte

Die Bezeichnung «GOLF CLUB CARD Mallorca», die Website, Produktbezeichnung und das Design sind urheberrechtlich geschützt. Jegliche Nutzung oder Vervielfältigung ohne Zustimmung des Anbieters ist untersagt. Anbieter im Sinne dieser AGB ist die Arena Sportwerbung AG. Auch wenn im Aussenauftritt unter der Bezeichnung «GOLF CLUB CARD Mallorca» kommuniziert wird, bleibt die Arena Sportwerbung AG alleiniger Vertragspartner.

14. Anwendbares Recht und Gerichtsstand

Es gilt schweizerisches Recht unter Ausschluss des UN-Kaufrechts. Für Verbraucher ausserhalb der Schweiz gelten zusätzlich die zwingenden Bestimmungen des Wohnsitzstaates. Gerichtsstand ist der Sitz des Anbieters, sofern nicht zwingende gesetzliche Bestimmungen des Wohnsitzstaates des Verbrauchers entgegenstehen.

15. Vertragssprache

Die Vertragssprache ist Deutsch. Übersetzungen dienen ausschliesslich der Information.

16. Streitbeilegung

Der Anbieter nimmt nicht an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teil.

17. Sonstiges

Angaben auf der Website oder im Kundenkonto zu Buchungsabläufen, Preisen, erforderlichen Handicaps, Kleiderordnung oder sonstigen Partnerbedingungen dienen nur der Orientierung. Verbindlich sind allein die AGB der Partnerunternehmen sowie diese AGB. Eine Haftung des Anbieters für Richtigkeit, Vollständigkeit oder Aktualität dieser Informationen ist ausgeschlossen.

18. Schlussbestimmungen

Sollte eine Bestimmung dieser AGB unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt. Änderungen dieser AGB werden in Textform bekannt gegeben. Massgeblich ist die zum Zeitpunkt der Bestellung gültige Fassung.
